This is the general rule of priority for national employment. In other words, jobs in France must be offered first and foremost to French nationals, EU citizens and foreigners authorized to work.
The employment situation is assessed by means of Pôle emploi statistics, which evaluate the "tension rate" per profession in the region concerned. If this rate is low, the employment situation can be invoked against the work permit application, which will be refused.
When applying for a work permit, the prefect checks that the employer has carried out a local search for the manpower he needs (with a few exceptions).
So, before applying for a work permit for a foreign employee in France, the first thing you should do is post a vacancy on the Pôle Emploi website and examine the applications you receive. If you receive no applications, or very few, Pôle Emploi will issue you with an attestation for the introduction of a foreign workforce, which will prove that you have taken steps to recruit foreign workers on a national level, and will prevent the employment from being challenged.
