Our client is the mother of a French national with whom she lives in Guinea. She has made frequent trips to France to visit the child's father. She has a stable situation in her country and holds a permanent job. She applied for a visa for France in June 2022 at the French consulate in Conakry and, curiously, was refused on the grounds that there was reasonable doubt as to whether she intended to leave French territory before her visa expired.
In short, the consulate refused on the grounds that there was a risk that she would not respect her visa.
We therefore contested the appeal before the Commission de Recours (CRRV) and then before the Tribunal Administratif de Nantes. We demonstrated that our client had always respected the visas she had applied for, that the consulate and the CRRV had not properly assessed our client's situation and had therefore issued illegal decisions.
The Nantes Administrative Court therefore rightly annulled the visa refusal, with an injunction to issue the visa within two (2) months.
