The Talent Passport – Skilled Employee is a multi-year residence permit that allows highly skilled foreign nationals to work in France. It is valid for a maximum of four years. It is granted in particular to individuals who hold a higher education degree or who are recruited by an innovative company, or as part of an intra-group assignment, provided that they receive a minimum gross annual salary of €39,582.
1. The rule laid down by the CESEDA
The last paragraph of Article L.421-9 of the Code on the Entry and Stay of Foreigners and the Right of Asylum (CESEDA) states that:
“When a foreign national holding a ”Talent Passport - Skilled Employee“ or ”Innovative Company" residence permit finds themselves involuntarily unemployed on the date of renewal of their permit, the permit shall be renewed for a period equivalent to the period of entitlement to the aforementioned insurance allowance. "
In other words, loss of employment does not prevent the card from being renewed, provided that the foreign national can prove their entitlement to unemployment benefits.
2. Steps to take if you lose your job
Mandatory registration with Pôle Emploi: foreign nationals must register immediately as job seekers.
Obtaining proof of unemployment benefits: this document is the key piece of evidence for renewal.
Submitting the renewal application: the card is then renewed for a period equivalent to the duration of unemployment insurance benefits.
3. Finding a job while unemployed
If the job meets the Talent Passport criteria: the authorities must be informed so that the file can be updated, and the card will continue under the same conditions.
If the job no longer meets the criteria of the Talent Passport: a change of status to an “employee” residence permit is mandatory.
This involves a work permit application by the employer;
Then the submission of an application for an “employee” residence permit.
4. Conclusion
The legislator has provided specific protection for holders of the “Skilled Employee” Talent Passport who lose their jobs. Renewal remains possible, but is conditional on rapid registration for unemployment and presentation of proof of entitlement. This mechanism ensures continuity of residence while offering the possibility of finding another job that complies with the scheme, or switching to another appropriate status.
