Depending on your plans, several long-stay visas (type D) are available:

Family reasons: “family reunification” or “spouse of a French national” visa, allowing relatives to join a legal resident in France.

Studies: student visa to pursue a course of study lasting at least two years after high school, or a long-term internship/training program.

Professional/business: professional visa, in particular the Talent Passport (categories: mission, innovative startup, talents) or standard employee visa.

Other reasons: for medical reasons, retirees, family caregivers, etc.

Essential preparation: from application to review

You start by submitting an online application on the official website. You must make an appointment at the consulate or approved center 3 to 6 months before your planned departure, depending on your plans and local availability. The application includes: the form, supporting documents, a compliant photo, and biometric fingerprints. You will be given a receipt confirming the date your application was submitted.

Standard processing times: 15 to 60 days

Under normal circumstances, applications are processed within 15 to 60 days of receipt. Priority cases, such as student or family visas, are processed more quickly (sometimes within 30 days). However, there is no formal guarantee regarding the maximum processing time.

The decisive impact of Article R.811-2 of the CESEDA

Article R.811-2 allows consular authorities to carry out in-depth document checks, mainly relating to the validity of civil status documents (birth, marriage, divorce). This includes checking apostilles, translations, and the reliability of registers within a renewable period of four months.

This verification results in a legal suspension of the standard time limits, and the investigation may be extended well beyond eight months, sometimes up to ten or twelve months. These checks are justified by the need to ensure the authenticity of the documents and to prevent fraud.

Cases of extension: up to and beyond eight months

When Article R.811-2 CESEDA is activated, failure to respond within eight months is considered an implicit rejection. This prolonged silence triggers a series of possibilities:

Request the reasons for the decision from the consulate or the Appeals Commission (CRRV).

Refer the matter to the Visa Refusal Appeals Commission (CRRV) within 30 days of the implicit or explicit rejection.

If the CRRV rejects your appeal, you can refer the matter to the Nantes Administrative Court within the following two months, including to obtain the reasons for the decision.

An emergency procedure (summary proceedings) is also possible, allowing you to obtain a provisional decision within 48 hours in cases of proven urgency.

Practical consequences for your project

Students: a delay of more than eight months may compromise your admission to a university program, administrative registration, or scholarships.

Spouse of a French national: an extended stay without a visa blocks family reunification, access to social rights, or health insurance.

Professional/talent: a delay delays the start of employment, the launch of a project, or participation in an intra-group project.

Anticipating these uncertainties by taking into account scenarios of up to 12 months is essential to secure your project.

Tips for limiting delays

Complete and flawless application: apostilled and translated documents, perfect compliance.

Responsiveness: follow up with the consulate after 45 days without news.

Preparation for appeals: build a solid case from the outset to refer the matter to the CRRV and the TA if necessary.

For more information

Communication of reasons: assert your right to know the reasons for the silence by writing to the consulate or the CRRV.

Administrative seizures: informal appeal, CRRV appeal, contentious appeal to the TA.

Urgency: appeal for summary judgment to obtain a quick provisional decision.

Conclusion and support from FB Avocat

In summary, although the “standard” time limits vary from 15 to 60 days, Article R.811-2 of the CESEDA may extend the investigation to 8-12 months in the event of verification of civil status documents. Failure to respond within 8 months triggers an implicit rejection. You can then lodge an appeal with the CRRV, obtain the reasons for the decision, refer the matter to the Nantes Administrative Court, and possibly file an application for interim relief.

To ensure that your application is successful, FB Avocat – Me Babou will assist you every step of the way: putting together a strong case file, proactive follow-up, managing reminders, appeal strategy, until you obtain your decision, under the best legal and personal conditions.
